Secursuit Terms of Service
Effective date: January 2025
These Terms of Service (“Terms”) govern your access to and use of the Secursuit website, digital content, and professional services. By engaging with Secursuit, you agree to comply with these Terms.
1. Services
Secursuit provides cybersecurity consulting, managed services, and related delivery support. Each engagement is defined by a Statement of Work (SoW) or Master Services Agreement (MSA) outlining scope, deliverables, timelines, fees, and any unique terms.
Unless otherwise agreed in writing, Secursuit retains ownership of methodologies, frameworks, automation assets, and intellectual property developed prior to or independent of the engagement. Customers receive a non-exclusive licence to use deliverables internally.
2. Customer responsibilities
- • Provide timely access to systems, personnel, documentation, and environments necessary for service delivery.
- • Maintain appropriate backups and disaster recovery processes prior to any remediation or deployment activity.
- • Ensure that information supplied to Secursuit is accurate, current, and lawful to share.
- • Assign a primary point of contact to coordinate approvals and decisions.
3. Confidentiality & data protection
Both parties agree to protect Confidential Information using a level of care consistent with industry standards. Confidential Information may only be used for the purposes defined in the engagement agreement. Secursuit processes personal data in accordance with applicable privacy legislation, including POPIA and GDPR where relevant. Additional data processing terms can be incorporated into the SoW or MSA.
4. Security testing
Customers authorise Secursuit to perform security assessments, monitoring, and remediation activities on agreed systems. Any use of live credentials, production data, or social engineering techniques will be explicitly documented and approved.
Secursuit will take reasonable steps to avoid service disruption; however, customers remain responsible for communicating maintenance windows and rollback procedures.
5. Fees & payment
Fees are payable according to the schedule defined in the relevant SoW or MSA. Late payments may result in suspension of services or additional charges. All amounts are exclusive of taxes, levies, or duties imposed by taxing authorities, which remain the responsibility of the customer.
6. Warranties & disclaimers
Secursuit warrants that it will deliver services with reasonable skill and care consistent with industry standards. Other than expressly stated, Secursuit provides no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. Security cannot be guaranteed; customers accept residual risk inherent in complex digital environments.
7. Liability
To the maximum extent permitted by law, Secursuit's total liability arising out of or related to an engagement is limited to the fees paid by the customer for the services giving rise to the claim. Neither party is liable for indirect, incidental, special, or consequential damages, including loss of profits, revenue, or data.
8. Termination
Either party may terminate an engagement for material breach if the breach is not remedied within thirty (30) days of written notice. Upon termination, customers remain responsible for paying fees for services performed up to the termination date.
9. Updates
Secursuit may update these Terms from time to time to reflect changes in legislation, services, or business operations. The “Effective date” above will be revised accordingly. Continued use of Secursuit services following changes constitutes acceptance of the revised Terms.
